A Novel Idea
In this case, our client was interested in branding its apparel line with a name that is the trademark of the largest retail chain in its industry in Canada. Obviously, the brand is well known, so the client had to be sure the chain was not already using the mark on apparel. We reviewed the corporate website and visited stores to assess its inventory and view any apparel it offered for sale. We also telephoned the stores, and finally confirmed that the chain absolutely did not carry apparel using the mark in question. We provided our client with sufficient information to move forward with its new line of apparel.
